SHIPPING POLICY

This shipping policy explains how we handle shipping of products purchased through our website.

1. Definitions

For the purposes of this Shipping Policy:

1.1. “Agreement” means the contractual relationship formed when the Customer places an Order on the Digital Properties, including all applicable Site Policies.

1.2. “Business Day” and “Business Days” means any day other than a Saturday, Sunday, or public holiday in Vietnam.

1.3. “Carrier” means any third-party logistics provider, postal service, shipping company, or courier engaged to deliver an Order.

1.4. “Claim” means a request submitted by the Customer under this Shipping Policy.

1.5. “Company”, “we”, “us”, and “our” means Soyon (Vietnam) Company Limited, including its subsidiaries, affiliates, officers, directors, employees, agents, and authorised representatives. Harāra is a brand owned and operated by the Company.

1.6. “Customer”, “you”, your” means any individual or legal entity that purchases Products through the Digital Properties.

1.7. “Digital Property” and “Digital Properties” means website, ecommerce store, social media account, platform, application, software, API, digital channel, or other online service or presence that is operated or controlled by the Company and which the Company markets, sells, distributes, or supports its Products or services, including without limitation https://harara.run/ and official Harāra social media accounts operated by the Company.

1.8. “Dispute” means any dispute, controversy, or disagreement arising out of or relating to the rejection, handling, processing, or outcome of a Claim, or otherwise arising out of or relating to this Shipping Policy.

1.9. “Order” means a completed purchase transaction submitted through the Digital Properties, including Products, shipping services, and any add-on services.

1.10. “Product” and “Products” means any goods offered for sale by the Company through the Digital Properties.

1.11. “Restocking Fee” means the fee charged to cover the costs of inspecting, sanitising, repackaging, and returning an item to inventory. The Restocking Fee is calculated as a percentage of the Product’s advertised price.

1.12. “Site Policies” means, collectively, the Extended Purchase Warranty Policy, Privacy Policy, Returns & Exchanges Policy, Shipping Policy, and the Terms & Conditions.

2. Order Processing Time

2.1. All Orders are processed in Vietnam during business hours, Monday to Friday, between 9:00 AM and 5:00 PM. For a list of public holidays we observe, please refer to https://publicholidays.vn/.

2.2. Unless otherwise stated, Orders are processed for shipment within 3 Business Days after payment is received.

2.3. We will contact you by email if your Order cannot be shipped within this timeframe.

3. Estimated Delivery

3.1. Available shipping options and estimated delivery timeframes are displayed at checkout.

3.2. Estimated delivery timeframes are provided in good faith for convenience only. Delivery may be affected by factors outside our control, including Carrier operations, transport restrictions, customs processing, and other unforeseen delays. Accordingly, estimated delivery timeframes do not form part of the Agreement and are not contractually guaranteed.

4. Delivery to PO Boxes

4.1. Due to size, weight, Carrier limitations, or customs restrictions, some Products may not be eligible for delivery to PO boxes or may experience delays when shipped to a PO box address. If the selected Carrier cannot deliver to a PO box, we may either select an alternative Carrier at our discretion or contact you to arrange delivery to an alternative address.

5. Shipping Costs

5.1. Available shipping options and estimated shipping costs are displayed at checkout.

6. Duties, Taxes, Tariffs, and Custom Fees

6.1. Unless stated otherwise, Products are shipped from Vietnam. If your delivery address is outside Vietnam, you may be required to pay duties, taxes, tariffs, customs fees, and other charges imposed by authorities outside Vietnam.

6.2. You are responsible for all import taxes, customs duties, and other fees imposed by authorities outside Vietnam. Please cooperate with the Carrier and relevant authorities, and ensure all required fees are paid. Failure to cooperate with customs clearance processes may result in the package being destroyed or abandoned by local authorities. We are not responsible for any resulting losses and are unable to provide customer support in such cases.

7. Title and Risk of Loss

7.1. All purchases are made pursuant to a shipment contract. Risk of loss and title to Products pass to you once the Carrier has collected the shipment from our warehouse. We are not responsible for loss, theft, or damage occurring during and after transit.

7.2. In some countries, we offer optional Extended Purchase Warranty, which may be available during checkout depending on your location. This optional service provides additional protection for shipment loss, theft, or damage during transit, together with other benefits described in the Extended Purchase Warranty Policy.

8. Delayed, Lost, and Damaged Shipments

8.1. All shipments include a tracking number. Once your shipment has been collected by the Carrier, you will receive a shipping confirmation email containing the Carrier’s details and tracking number.

8.2. If you do not receive your Product within the estimated delivery timeframe, please contact the Carrier directly or use the provided tracking number on the Carrier’s website to check the shipment status.

8.3. If the Carrier is unable to deliver your package, they may provide instructions for collection or redelivery. If the package is returned to us and you did not purchase an Extended Purchase Warranty, you may either forfeit your Order without any refund or pay a 12.5% Restocking Fee together with all associated shipping costs to have the Product reshipped to you.

8.4. If you purchased an Extended Purchase Warranty and do not receive your Product within the estimated delivery timeframe, you may submit a claim with us. Please refer to the Extended Purchase Warranty Policy for details regarding eligibility, limitations, and the claims process.

8.5. We are not responsible for any costs, fees, damages, consequential losses, liabilities, or other expenses arising from delayed delivery.

9. Changes to Orders or Delivery Addresses

9.1. Requests to modify an Order, including cancellations, delivery address changes, additions, removals, Product substitutions, or shipping option changes, should be submitted as soon as possible. Please contact us at shop@harara.run, include your Order number, and describe the requested changes.

9.2. We may accommodate Order changes provided the Order has not yet been processed by our warehouse. Administrative, processing, restocking, Carrier, and/or banking fees may apply, and we will notify you of any applicable costs before confirming the change.

9.3. Once an Order has been processed by our warehouse, a 12.5% Restocking Fee will apply to any approved changes relating to the Order.

9.4. Once an Order has been collected by the Carrier, we cannot accommodate changes to the Order or delivery address.

10. Language Versions

10.1. This Shipping Policy may be translated into languages other than English for convenience purposes only.

10.2. If there is any inconsistency between the English version and a translated version of this Shipping Policy, the English version will prevail.

11. Governing Law

11.1. This Shipping Policy shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to any conflict of laws principles.

12. Dispute Resolution

12.1. Any Dispute shall first be resolved through good faith informal negotiations between the Parties.

12.2. If the Dispute cannot be resolved through informal negotiations, it shall be finally and exclusively resolved by arbitration administered by the Middle Commercial Arbitration Center (“MCAC”) in Danang City, Vietnam, in accordance with the applicable MCAC Arbitration Rules.

12.3. The arbitration shall be conducted in English, and the arbitral award shall be final and binding.

12.4. Any notice and procedural requirements set out in the Terms & Conditions or this Shipping Policy shall apply to dispute resolution, to the extent not inconsistent with the applicable MCAC Arbitration Rules.

13. Relationship to Site Policies and Entire Agreement

13.1. This Shipping Policy forms part of the Agreement together with the following Site Policies:

(a) Extended Purchase Warranty;
(b) Returns & Exchanges Policy;
(c) Shipping Policy; and
(d) Terms & Conditions

13.2. For the avoidance of doubt, the Site Policies are incorporated into and form part of the Agreement.

13.3. In the event of any inconsistency between this Shipping Policy and the Terms & Conditions, the Terms & Conditions shall prevail to the extent of the inconsistency.

13.4. The Agreement constitutes the entire agreement between the Parties relating to its subject matter of this Shipping Policy, and supersedes all prior or contemporaneous discussions, negotiations, representations, warranties, communications, and understandings, whether oral or written, relating to that subject matter.

14. Policy Changes

14.1. We reserve the right to modify or update this Shipping Policy from time to time.

14.2. If we make material changes to this Shipping Policy, we will provide notice by posting the updated version on the Digital Properties or by other reasonable means.

14.3. We may update the “Last updated” date displayed at the beginning of the Shipping Policy to reflect the date of any modification or update.

14.4. Unless otherwise required by applicable law, material changes to this Shipping Policy will take effect 30 calendar days after notice is provided. Your continued access to or use of the Digital Properties after the effective date of the revised Shipping Policy constitutes your acceptance of the revised terms.

14.5. Notwithstanding the foregoing, changes required for legal compliance, fraud prevention, security, or operational necessity may take effect immediately upon posting where permitted by applicable law.

14.6. If you do not agree to the revised Shipping Policy, you must stop using the Digital Properties before the changes take effect.
